Petition To Protect and Keep the Rights and Freedoms of Property Owners in Sonoma County and to Demand Rejection of the General Plan 2020
1. Whereas: The Sonoma County General Plan 2020 with its "Riparian Corridors" of 100 ft or 200 ft setbacks is in violation of the 5th Amendment to the US Constitution and the California Constitution, Art. 1, Sec. 19 which prohibits any person from being "deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use without just compensation." The GP is essentially "taking" private property and turning it into "public land" corridors without due process of law and with no compensation to the property owners. (The California Constitution, states that the compensation must be made first to the owner before any taking takes place.)
2. Whereas: The SCGP 2020 is in violation of the 14th Amendment, which prohibits any "State" from depriving "any person of life, liberty, or property without due process of law:" And it is violation of the Constitution of the State of California Article I, Sec. 1, which states that we have "inalienable rights" [to] "acquiring, possessing, and protecting property...safety, happiness, and privacy." The GP2020 will be exposing both the "State" and County to libel suits for not protecting our property rights.
3. Whereas: The SCGP 2020 is in violation od the 4th Amendment and the California Constitution Article I, Section 13, which grants a person the right to be secure in his ...houses ...against unreasonable ...seizures. According to the GP2020, buildings within the 100 ft setback will now be reclassified as "Legal Non-Conforming. A home, barn, shop etc. cannot be remodeled or added onto and if burnt, 50% or more cannot be rebuilt. A person can no longer feel secure in his home and his rights of property ownership to do with his home what he would choose have been effectively "seized" or taken away by virtue of this reclassification.
4. Whereas: The Sonoma County GP 2020 has no scientific evidence or prior history proving that there is any crisis of land mismanagement requiring a need for such massive control of private owners and their property.
5. Whereas: There is no evidence or history that shows that streams or biotic habitats are better taken care of in the hands of government agencies than the property owner himself. In fact the history of the United States and its free enterprise system versus the history of oppressive dictatorships has proven just the opposite.
6. Whereas: Much of The SC GP 2020 zoning recomendations are based on arbitrary, egregious, capricious whims, ideologies, and prejudices that result in fraudulantly marked maps of individual properties identifying "biotic habitats" that are not supported by true scientific validation. We intuit a pre-planned agenda for widespread ecological "taking" and converting private lands into "open space. "
7. Whereas: The SCGP2020 is a violation of the basic freedoms and rights that come with property owner-ship that have been a long standing part of the foundation of our nation and our heritage. The basic rights of life, liberty, and property are to be "secured" by government, not taken away. We object to all the restrictions that will now be imposed on us: the inability to grow crops for our livelyhood within the setbacks, to use power tools to maintain our streams and land, to use proper lighting and fencing to make our homes safe, and restrictions on our freedom to travel.
8. Whereas: The Sonoma County GP 2020 would be very costly not only to the property owners who have to go on paying taxes for land they can’t use, but to the county. There will be huge county debt, (about 9 billion) loss in revenue, high costs for law suits and the potential for a large depression, loss of property taxes that fund schools, highways, etc, higher costs for food and the necessities of life, and higher costs of rent.9. Whereas: There are counties and cities that have already implemented such plans as GP2020 that we can learn from. Santa Cruz, CA, has had Agenda 21 (Sustainable Development) running their lives since 1990. They have great debt, high crime rate, degradation of property and streams, transients and homeless people living in their backyards along their waterways defecating, defacing and bathing in "once pristine rivers and streams." Is that what we want?
10. Whereas: By the rejection of the General Plan 2020 a tremendous amount of money will be saved, we recommend using some of that money for education purposes to promote a balanced science format in the schools and to educate the media and public about the truth concerning private ownership of property and the free enterprise system as part of the strong fouundation upon which this nation has been built. We suggest property owners as presenters. Therefore, for all the above reasons, we the undersigned property owners and residents of Sonoma County, hereby demand that our Sonoma County Board of Supervisors, our elected officials, honor their oath of office and do what they are supposed to do - secure our rights to life, liberty, and property, not take them away, and reject the Sonoma County General Plan 2020 in its entirety.
(Prepared by Orlean Koehle and Wendy Albrecht, with approval of Gloria and Everett Ball, Thia Kellner Hill, Maria Donnelley, Patti Moreci, and Attorney Fred Kelly Grant of Stewards of the Range. Please return these petitions to Sonoma County Property Owners Association PO Box 5335, Santa Rosa, CA, 95402)

TAKE ACTION! - Yes on Identity Information Protection Act.

Write or call your representatives and ask them to VOTE YES on SB 768. Go here: http://www.privacy.ca.gov/califlegis.htm
Radio Frequency Identification (RFID) tags (tiny computer chips) are
included in California ID’s - drivers’ licenses, student ID’s, medical
cards, etc. without safeguards for privacy. Anyone with an RFID scanner can read the stored data on the chips, exposing you to the risk of identity theft, tracking and stalking. (SB 768) will protect Californians by requiring proper protections for the use of RFID technology in government-issued ID’s.
